LYMBR™ Waiver

In consideration of gaining access to participate in activities associated with LYMBR and its facility and equipment, I do hereby waive and release and forever discharge LYMBR and its officers, agents, employees, representatives, executors, and all others from any and all responsibilities or liability for injuries or damages resulting from my participation in any stretch and related activities. I have had the opportunity to discuss my specific needs in relation to this activity and, as a result, I do voluntarily request to participate in this program of stretch.

In consideration of the above factors, the undersigned participant acknowledges the existence of risks in connection with these activities, assumes such risks, and agrees to accept the responsibilities for any injuries sustained by the participant in the course of the use of the facilities and/or its equipment. Most specifically, the participant acknowledges and accepts responsibility for injuries arising out of those activities that involve risk in any of the following areas: use of the facility, the performance of fitness-related evaluations to assess functional capacity, the participation in individual/group activities related to stretch and activity, or incidents which occur within the facility, locker rooms, dressing rooms, showers, and other areas associated with LYMBR.

It is recommended, but not required that participants consult with a physician before engaging in any activities associated with LYMBR. Having read the preceding, the participant acknowledges full understanding of risks set forth herein and knowingly agrees to accept full responsibility for the participant’s own exposures to such risks and to waive all responsibility and liability of LYMBR.

I represent and acknowledge that I have read and understand this Consent, Release of Liability and Waiver and understand that my voluntary execution evidences my agreement to the terms, provisions, waivers, and releases as set forth above. I acknowledge that I have had an opportunity to review this Consent, Release of Liability, and Waiver with advisors of my choosing prior to participation in/receipt of any of the Services. The invalidity, in whole or in part, of any portion of the above paragraphs will not affect the remainder of this form.
